Legal Requirements
1. Gas Safety Certificate
✔ All gas appliances must be checked annually by a Gas Safe registered engineer.
✔ Provide tenants with a copy before move-in or within 28 days of inspection.
2. Energy Performance Certificate (EPC)
✔ The property must have a valid EPC (minimum rating of E) unless exempt.
✔ A copy must be given to the tenant.
3. Licensing Requirements
✔ HMO (House in Multiple Occupation) properties require a licence from the local council.
✔ Some councils also require Selective Licensing – check if your property is affected.
4. Electrical Safety (EICR & PAT Testing)
✔ An Electrical Installation Condition Report (EICR) must be conducted at least every five years.
✔ A copy of the EICR must be provided to tenants.
✔ Portable appliances must undergo PAT testing (recommended for furnished properties).
5. Fire Safety Regulations
✔ Smoke alarms must be installed on every floor and tested regularly.
✔ Carbon monoxide alarms are required in rooms with solid fuel-burning appliances.
✔ Fire exits and escape routes must be clearly marked and accessible.
6. Right to Rent Checks
✔ Verify that tenants have legal residency status in the UK.
✔ Carry out checks for all adult occupants.
7. Anti-Money Laundering (AML) Checks
✔ Letting agents must conduct Customer Due Diligence (CDD) checks on tenants and landlords.
✔ Required for any rental agreements with a monthly rent of £8,800 or more.
8. Tenancy Deposit Protection
✔ All deposits must be placed in a government-approved protection scheme.
✔ Provide tenants with Prescribed Information within 30 days of receiving the deposit.
9. ‘How to Rent’ Guide
✔ Provide tenants with an up-to-date copy of the official government guide.
10. Housing Health and Safety Rating System (HHSRS) Compliance
✔ Ensure the property is free from serious hazards.
✔ Maintain structural elements, drains, sanitary fixtures, ventilation, heating, and hot water systems.
